Le procureur de la République au Tribunal de grande instance de Nanterre, répond longuement à une interview de Cyrille Louis, dans Le Figaro.
Il argumente point par point.
Jusqu’à une question concernant les fameux enregistrements “sauvages” de Liliane Bettencourt, publiés par Mediapart et Le Point.
“Pourquoi refusez-vous de transmettre les enregistrements à Mme Prévost-Desprez, qui instruit un supplément d’information dans l’affaire Bettencourt ?”
“Je ne souhaite pas répondre à cette question“.
Bon.
Bah voilà.
Le procureur ne souhaite pas répondre à cette question.
Et donc il n’y répondra pas.
C’est commode.
Et on voit là toute la différence entre le métier de journaliste et celui de procureur.
Essayez donc de ne pas répondre à un procureur qui vous pose une question…
Il n’en demeure pas moins que pour clore l’interview, Philippe Courroye finit par dire clairement ce qu’il pense de ces enregistrements : “(…) un total dévoiement de l’administration de la preuve et un procédé d’une illicité et d’une indignité extrêmes”.
Cette dernière phrase est importante.
Sur le fond, elle nous dit tout le mal que Philippe Courroye pense de ces enregistrements et peut nous laisser présager de l’usage qu’il compte en faire.
Ou plutôt ne pas en faire.
Sur la forme, elle interpelle le très médiocre juriste qui sommeille – très profondément – en moi.
Pourquoi une aussi vilaine “illicité” s’est-elle glissée, à la place de la plus classique “illicéité“.
Bien sûr, il ne manque qu’une pauvre voyelle (é).
Et peut-être même l’”illicité” peut-elle, parfois, remplacer l’”illicéité” (les puristes jugeront).
Mais là, juste après son refus de répondre, ce relâchement stylistique – voire juridique – du procureur me chagrine.

on comprends aussi aux travers de cet interview, l’immense pouvoir dont il se croit investit ….au préjudice du droit.
La ficelle est bien grosse le petit citoyen a qui on balance de la morale à deux balle, en barre en tonneau en tresse, comprends que la loi c’est pas fait pour le popoulo;
Même les illettrés comprennent que nous sommes revenus a une justice-police à la javert.
Jamais vu autant de ministres et président porter plainte pour tout et rien il suffit que leur image soit mise à mal, contestée ou caricaturée.
Jamais vu un magistrat aussi cynique, défendre ouvertement le droit des puissants.
Philippe Courroye est à la justice ce que Jean-Pierre Pernaut est au journalisme et réciproquement.
Ce qui me fascine le plus, c’est qu’il n’ait accepté de répondre qu’au Figaro. J’ai du mal à y croire mais si c’est vrai, c’est d’un cynisme déconcertant.
Pour ce procureur on dit pas plutôt “illécécité” ?

Il s’agit certainement d’une faute de retranscription, les mecs comme Courroye maitrise parfaitement le sens des mots. Après, son refus de répondre à la question principale de transmettre à sa collègue les enregistrements est un aveu lourd de sens. Il trouve le temps d’aller à l’Opéra, c’est significatif de son cynisme.
Concernant l’affaire dont vous parlez je dois dire que la question auquel refuse de répondre le procureur n’est pas la question …
La vrai question que le journaliste aurait du lui poser :
Dans les enregistrements Mr De Maistre dit à sa Patronne qu’après une rencontre avec Mr Ouart votre décision lui a été communiquée 4 mois avant qu’elle soit rendue publique !!!
Avez-vous interrogé Mr De Maistre sur ce point ?
Allé vous interroger Mr Ouart ?
Allez-vous vous mettre en garde à vue pour répondre aux questions de la justice concernant ce point ???

Le juge est une “Courroye” de transmission entre l’Elysée et Neuilly. Je sais c’est facile.
… si l’on éprouve le besoin de communiquer dans la presse (dans un journal “ami” qui plus est)… c’est peut-être parce qu’on sent le socle du bon droit, sur lequel on est censé être assis, vaciller…

Il y a une chose que je ne comprends pas dans cet histoire. Comment le procureur Courroye peut-il refuser de transmettre les enrégistrements au juge Prévost-Desprez sans se faire rappeller à l’ordre par son hierarchie? Si j’ai bien suivi l’affaire, Courroye dépend de Versailles. Ses supérieurs semblent être très discrets ( complices ?) sur ce qui me paraît être une entrave à la justice ou, au moins, un obstacle à la recherche de la vérité. La juge Prévost- Desprez ne peut-elle pas exiger la transmission des enrégistrements afin de mener son enquête? Ne peut-elle pas compter sur le soutien des institutions judiciaires qui, elles, surveillent le bon déroulement de l’enquête? Ou sont-ils toutes et tous soumis?
Pourquoi alors avoir écrit illécéité à la place de illicéité ?
Ce relâchement orthographique me chagrine

Philippe Courroye est pris en flagrant délit de mensonge. Philippe Courroye prétend dans LE FIGARO : “Les propos prêtés par Mediapart à Claire Thibout concernant un financement politique généralisé ont été démentis par ses auditions devant les enquêteurs.”
Or, c’est faux.
Lisez ce qu’a déclaré Antoine Gillot, l’avocat de Claire Thibout :
Me Gillot affirme encore que sa cliente “ne s’est aucunement rétractée et a maintenu mot pour mot” ce qu’elle avait déclaré au journaliste de Mediapart. Notamment les “espèces demandées” par Patrice de Maistre “pour la campagne présidentielle de Nicolas Sarkozy” et le versement de ces fortes sommes en liquide à Eric Woerth.
Claire Thibout confirme également les visites de Nicolas Sarkozy chez Liliane Bettencourt, comme d’autres hommes politiques de droite. Et qu’à l’occasion de ces visites de politiques, “il lui était demandé de préparer des enveloppes avec des espèces”, explique l’avocat.
Monsieur et Madame Bettencourt “se montraient très généreux avec les personnels politiques de droite”, a-t-elle réaffirmé aux enquêteurs. Tout en concédant que Claire Thibout n’avait jamais assisté personnellement à des remises d’enveloppes.
“Je crois que la vérité va sortir”, pronostique l’avocat, évoquant les documents produits par le site marianne2.fr (près de 400.000 euros sortis en liquide dans les mois qui ont précédé l’élection présidentielle, ndlr).
